Serious Child Abuse Cases in Phoenix

Arizona Woman Convicted for Child Abuse

So as a child everyone remembers the fun of playing in a plastic container or cardboard box. However, for one innocent child, it didn’t turn out so fun.

An Arizona woman is being convicted of first degree murder for the death of her ten year old cousin. Her ten year old little cousin was locked in a small plastic storage box, in deadly hot heat.

Twenty-eight year old, Sammantha Allen has been accused and convicted of helping her husband, lock he cousin, Ame Deal in a box. The box was left outside overnight. This was used as a sick punishment against the poor child.

The bin only had small air holes near the handles. The prosecutors are seeking the death penalty for the woman. The penalty part of the trial will begin next week.

According to reports, the young child was suffocated and found dead the next day. The temperatures had surpassed 100 degrees.

Child Abuse

The female was also found guilty of three counts of child abuse as well as conspiracy to commit child abuse. As if this isn’t one of the saddest things you’ve ever heard, wait until you hear why the child was being punished. The child was put in the burning box because she stole and ate a popsicle.

When the young girls body was found, they family said that she had “hidden” in there as they were playing a late night game of hide and seek.

According to reports, this was a form of punishment that was done regularly done by the request of the legal guardian of the girl, Cynthia Stoltzmann.

Apparently the child had a long life of child abuse in her short life. Not just by one relative either, apparently several. The young girl has lived with at least ten adults and children.

Three other relatives have also been convicted of abusing the little girl. They are already serving time in prison.

The girl’s father, David Deal had previously pleaded guilty for attempted child abused and was sentenced to jailed. Stoltzmann was also sentenced to twenty-five years in prison for attempted child abuse.

In 2011 there were reports that the little girl had lived in a house of “horrors”. Police reported that the adults that were supposed to take care of her were actually making her sleep on the floor of the shower stall! They even put hot sauce in her mouth when she lied. They sadly locked in her in an airtight chest as a punishment. What kind of sick family did this little girl live with? So sad that they couldn’t help her.

Phoenix Police Sgt. Trent Crump’s Statement:

I don’t think that a crime could be more unspeakable.

Phoenix Domestic Violence Lawyer

Criminal Defense Cases

The highly skilled Attorneys at Criminal Defense Lawyers PLLC advise and represent people facing criminal charges for domestic violence often described as Spousal Abuse, Spousal Battery or Domestic Dispute, such charges do not always reflect a case between married people, but include those living in the same location (cohabitation), or sometimes just engaged in a domestic (dating) relationship.  Such cases can also lead to violation of a restraining order or protective orders.  They are NOT the same as a Domestic Violence Restraining Order however.

With a team of former prosecutors, Phoenix based Criminal Defense Attorneys at Criminal Defense Lawyers PLLC offer a comprehensive understanding of the criminal justice system. They understand the necessary steps to take in developing an aggressive defense strategy focused on securing a dismissal or minimizing any potential penalties associated with a conviction.

Domestic Violence cases have become extremely political and are regularly treated as “guilty until proven innocent.”   Even with minor cases, that do not involve a documented injury, proactive and rapid action by a caring defense attorney may be they key to not only avoiding a damaging no contact order, but may play a significant role in custody issues and an eventual resolution in the case that does not result in a life-time ban on the possession of firearms, tragic orders separating you from your family and other consequences that can interfere with work, school and life.

At the Law Offices of Criminal Defense Lawyers PLLC, we are committed to helping you achieve a resolution to your immediate problems, while seeking opportunities to improve the troubled family dynamics that might be underlying factors.

In domestic violence cases, the district attorney and the judge will be especially interested in what you’re willing to do to improve relationships, conflict resolution skills, and anger management. Your demonstration toward positive change will often make the difference in the outcome of your case. Police Investigate Phoenix Stabbings

Phoenix Stabbings

Phoenix has been overran by shootings and stabbings lately. Police have definitely stayed pretty busy. According to details recently released, there was a murder in north Phoenix. The body was found by a person passing by.

The police report shows that on June 3rd a person passing by saw a man who was unresponsive. This was in a parking lot near Pinnacle Peak and Cave Creek roads.  Can’t imagine how scary that would have been for the person just innocently passing by.

The victim was later identified as, Evin Ibrahim Paulos. He was pronounced dead at the scene of the incident. According to the police, Paulos had around 30 stab wounds. Talk about a horrible ending to his life.

The police has been able to identify a suspect in this case, however they are not releasing his name due to investigative purposes.

Investigating Stabbings

The Phoenix Police investigated the scene. Their report says that the suspect and the victim knew each other since the suspect moved to Arizona. Apparently he was a part of a drug and gang culture. He came to Arizona to try to get away from it. The suspect was described as “inappropriate and aggressive”.

Local witnesses say that the victim and suspect had had their differences before and had “sought to fight it out”.  Apparently on June 2nd, the two did actually fight. They fought by the lights from the headlights. The suspect even had the fight recorded on video. After the fight, the victim had went home and told his family that they had worked things out and were still friends.

Police found out that the next day the suspect went over to Paulos’ home in the morning. Paulos was going to take a trip with the suspect. That was the last time that Paulos was seen alive.

A family member contacted the suspect, he told them that the Paulos had jumped out of the vehicle, just down the street from his home and he kept driving. Crazy story, why would Paulos jump out of a vehicle if the two were on good terms?

The suspect is being hunted by the fugitive task force. He or she has already been charged with second degree murder.

Fatal Stabbing Kills a Woman

Sadly, domestic violence can lead to death. When things get bad enough for the cops to be called, it’s probably time to go your separate ways for the health of all of those involved. Sometimes, on very rare occasion, the victim in a domestic dispute gets away from their vindictive life and has a great new start, however that wasn’t the case when a woman was fatally stabbed.

In south Phoenix a woman sadly got stabbed during a domestic dispute. Police said that they responded to a report of a family fight around eleven o’clock in the morning. The home was located near 43rd Avenue and Baseline Road.

Police Identified Stabbing Victim

The police were able to find and identify a sixty year old woman named Mercy Gomez. Gomez was stabbed and later died at a nearby hospital.

Olanzo Gomez is forty-two years old and is accused of stabbing his mother to death. How tragic is it that a son stabbed the woman who gave him life?

Olanzo was detained and will face one count of first degree murder, as well as three counts of aggravated assault.

Phoenix Burglary Suspect Injured

Well if there isn’t enough scary stuff going on in the world today. like terrorism, IsIs and major wars. People just can’t live peacefully or do what’s right.

A Phoenix police officer says that a suspect was shot on a Saturday morning. It wasn’t by the police though, it was by the resident who had reportedly interrupted a burglary. Talk about a scary moment for both parties.

The officers were quick to respond to the scene. It happened near the 83rd Avenue and McDowell Road. It happened very early, just before daylight at five o’clock in the morning.

One of the nearby neighbor’s say that he could hear the gunshots. He said he could also hear someone screaming “I’m sorry, I’m sorry”. At first the neighbor thought it was a young child screaming at first. According to the reports, it was actually a woman who was in hiding.

One of the residents told the police that they did see a woman and she was burglarizing a work vehicle and had an altercation with her.

The Police say that the resident did fire some gunshots at the suspect and was able to hit her at least one time.  Luckily the suspect suffered from non-life threatening injuries, according to the police reports.

Murder of a 14 Year Old Girl Being Investigated

When a child is taken or runs away from home, you can’t help but imagine the worse. For one set of parents, they might be closer to having some answers about what happened to their little girl. Even if they are horribly sad, answers.

Police are investigating the murder of a fourteen year old girl. They think that maybe the case might be linked to a case where a twelve year old girl might have ran away from home.

On Wednesday morning, the San Diego Police Lt. Mike Hastings, stated that the body of a Anna Hernandez was found in a canyon, just off the 2900 block of Market Street on November 18th. Even though they found her on the 18th, they weren’t able to positively identify the girl until November 23rd.

According to the report, the young girl’s body was badly decomposed. The San Diego Medical Examiner’s autopsy proved that she sadly suffered from at least one gunshot wound to her upper body. Who in the world would want to shoot a fourteen  year old little girl?!

Lt. Hasting’s Statement About the Murder:

Regarding Anna’s homicide, the investigation continues including the processing of many items of evidence. The homicide team has served search warrants and conducted many interviews in the last seven days.

Nelly Espinoza who was twelve years old, was a friend of Hernandez. She lives in an apartment complex close to where Hernandez’s body was found. Nelly was last seen on November 13th. According to the police, the young girl isn’t considered a missing person, but a juvenile runaway.

The San Diego police recieved information that Nelly was with a family member in Northern Mexico She reportedly talked to her family, who live in San Diego, by phone. She told them that if they tried to look for her, then she would go deeper into Mexico.

Lt. Hastings said that Nelly could be with the sixteen year old runaway Janeth Mendoza. Janeth was last seen in October of this year. Both Tijuana and the San Diego police have put out missing persons fliers and are doing what they can to get to the bottom of this.

Lt. Hastings did not confirm if the investigating officers think that there is a link between Hernandez’s murder and Nelly Espinoza.

Hernandez recently transferred to the San Diego High School from High Tech High. Police have not released a possible motive in her killing. There has also been no arrests at this time.  The police are actually keeping quite about the possible suspects as well. Them being minors, I’m sure this case will be hard to handle publicity wise. I’m sure they’ll keep the public and the families updated as new information come in.

Phoenix Manslaughter Lawyer

At the Phoenix based Offices of Criminal Defense Lawyers PLLC, we have defended many clients charged with a violent crime, including murder charges and other high-level violent crimes. We can provide the strong defense you need if you have been charged with voluntary manslaughter or involuntary manslaughter.

If you discovered your spouse in bed with a lover and as a result killed your spouse in a sudden rage, you may have been charged with first-degree murder. However, you may only be guilty of voluntary manslaughter, an offense that carries a maximum prison sentence of 11 years, as opposed to a life sentence.

Manslaughter is defined as the unlawful killing of a human being without malice. The term malice is used in a highly technical sense and does not simply imply a feeling of anger.

Types of Manslaughter Defenses

If you have been charged with murder and the evidence is stacked against you to show that you did unlawfully kill another person, seeking a conviction to the lesser charge of voluntary manslaughter may make a significant difference in your case.

To effectively raise such a defense, you must be able to establish that you were provoked, that a reasonable person in such a situation might be similarly provoked to kill, and that you did not have sufficient time to cool off and further contemplate your actions. If retained as your counsel, we will thoroughly investigate the facts of your case to determine which defense strategy gives you the best opportunity to protect your freedom.

Types of Manslaughter Cases in Phoenix

In the state of Arizona, you may be charged with involuntary manslaughter under two separate circumstances:

  • If you committed a crime (other than a felony) and unintentionally caused the

death of another person.

  • If you were engaged in a lawful act that might cause death and acted without

“due caution and circumspection.”

Manslaughter Conviction and Sentencing

A conviction for involuntary manslaughter carries a maximum sentence of four years imprisonment. If you caused the unintentional death of another person and you were not committing a crime, it is not sufficient for the prosecution to allege that you made a mistake. The phrase “without due cause and circumspection” implies something more than a simple mistake. Our Phoenix Attorneys can raise a number of issues and defenses on your behalf to raise the strong defense you need. A plea to a lesser offense or a plea that allows you to avoid a criminal conviction may be possible depending on the facts of your case. If you choose to fight your charges at trial, we have the skilled trial lawyers to aggressively defend your rights in the courtroom.

Homicide Shooting

Woman Missing After Complex Shooting

Shootings rarely end well. Someone is hurt or killed and the suspect usually flees. Shooting cases can sometimes go unsolved for quite a while.

A lot of shooting cases become homicides pretty quickly. A homicide is when someone deliberately and unlawfully kills someone. Which makes it easy to understand why a shooting turns into a homicide. Usually you aren’t shooting at someone to do them any good. A shooting is to harm someone.

The Phoenix Police Department is now looking for a woman who can not be found. They’re searching for her because a man was shot and killed at an apartment complex.

According to the reports, a one year old child as well as a woman, Veronica Huerta Brown were not found after a man was killed on a Saturday night. The man was shot at an apartment complex, which is located near the 12th Street and Indian School Road.

The investigators said that the child and Brown were in a vehicle with the victim when the victim was then ordered out of the vehicle by two men. According to the police, the men shot the victim and then took the child from him.

At this time, it’s unclear if the woman and child were abducted by the suspects or whether they fled the scene separately.

The Phoenix Police gave an update about the situation on Sunday morning. They say that the child was luckily found safely however, Brown had not been found at this time. They are worried about Brown’s safety and are searching for her.

Police spokesman, James Holmes Statement:

We believe that all three, the victim, Veronica and (the child), arrived at this apartment complex, just before the shooting, together in a vehicle.

Holmes gave a description of the shooters, saying that they were described as Hispanic men. The men seemed to be at the apartment complex and they ordered the victim to get out of the car with the child.

Holmes’ Statement:

At that point, the suspect grabbed the child and fired on the victim and took the child and he left.

There were witnesses at the scene and they told the Phoenix Police that they had hear at least four gunshots.

Neighbor, Jennalee Yazzie’s Statement:

It was like, ‘Pom pom,’ and then, ‘Pom pom,’.

The police have no definite answers on whether the woman and the child were abducted by the suspects or if they actually fled the scene separately.

Holmes’ Statement:

We believe that all three, the victim, Veronica and (the child), arrived at this apartment complex, just before the shooting, together in a vehicle.

Holmes also said that the two shooters were already at the apartment complex and then ordered the victim to get out of the car with the child.

Holmes said that at that point of the situation, the suspect quickly grabbed the child and fired on the victim. He then took the child and left.

Neighbor, Bryan Cunningham’s Statement:

He said it was a very small white hatchback, is what he saw. And [the car] was moving quite fast, getting right out of there after the shots and the screams.

The witnesses also told the police that there were at least two male suspects that got away from the complex. They were in a 90’s model vehicle that is either a white Honda or could be a white Taurus.

At this time, it’s not clear what relationship the victim had with the two suspects or with the missing Brown woman, who police are still searching for. Police also don’t know what the relation was to the woman and child with the suspects or if there was one at all.

Holmes Statement:

We have to consider that both this female and this child, based on the violence that occurred here this afternoon, could very well be in danger.

Police are now looking for the 90’s model vehicle that fled the scene. The incident happened in the back parking lot of an apartment complex.

If anyone has any information at all as to where Brown may be, they are encouraged to please call the Phoenix Police Violent Crimes Bureau at (602) 262-6141. Of course, as always calls can remain anonymous.

Drive-By Shooting in Phoenix

A drive by shooting that happened on the outside of a Phoenix bar could have been pretty devastating. The police are still looking for answers regarding this case.

According to the news reports, there was a light colored Jeep that was seen outside of the Charley’s Place Bar at the 43rd Avenue and Thunderbird Road which happened after three o’clock in the morning on August 18, 2015.

According to a report there was an person in a Jeep SUV who reportedly fired several rifle rounds into the bar. Luckily, no one was injured during the shooting.

Silent Witness is offering a reward for any information that may be helpful in this unsolved case. They are offering $1,000.00.

If you have any information on this case, please contact the Silent Witness at 480-WITNESS.

Hopefully the shootings in Phoenix slow down and end in less fatalities like this drive by bar shooting. Shootings are scary but it’s a little less scary when no one is hurt. Which is rare in a shooting, especially in a drive by shooting.

Multiple Types of Murder Cases

Murder Crimes Near Phoenix

There are of course several types of murder. The most disturbing and unfathomable, in my opinion anyways, is Familicide. What is Familcide? It’s a term used when there is a multiple victim homicide where the killer’s spouse and children are killed.

Definition from Wikipedia

A familicide is a type of murder or murder-suicide in which at least one spouse and one or more children are killed,[1] or in which a parent or parents and possibly other relatives such as siblings and grandparents are killed.[2] In some cases all of the family members’ lives are taken. If only the parents are killed, the case may also be referred to as a parricide. Where all members of a family are killed, including when the killing takes the form of a murder-suicide, the crime may be referred to as family annihilation.

The cases I’ll be writing about today are similar but different. This first case is a lot like a familicide case.  The police have been able to identify the man who had been accused of decapitating a woman and two dogs. The man identified was identified as, Kenneth Wakefield.

The Phoenix Police Department are always helpful to the media. They have said that Wakefield was actually released from the hospital on Saturday afternoon. However, she was booked for a one count of 1st degree murder as well as two counts of animal cruelty. She was being held on a TWO million dollar bond money.

The believe that the suspect is known to have some physics and mental issues.  The two doggies were sadly found dead in the home.

On July 25th, the police had found the horrible crime scene. Which was located near 13th Place and Colter Street. They were able to easily locate the scene after a neighbor had went to check on the suspect and the victim. The neighbor knew that the suspect had mental issues.

The neighbor was quite shocked when, according to them, when the suspect, Wakefield had answered the door and the neighbor said that he was naked and also had a portion of his arm was cut off. Wakefield was a scary sight with his missing arm,and  missing right eye that was gouged out.

Wakefield didn’t try to deny what had happened. He admitted to the police officers that he had killed three of his own family members which were inside of the house.

Sadly, when Heisch was found she was decapitated as well as the dogs and in a closet. I feel so sorry for the victims and the police that found them I can’t imagine what a horrific scene that would have been.

The suspect was taken to the local hospital and had to undergo surgeries for his injuries. He was later released to the police after he was all fixed up.

Spouse Abuse or Murder?

Everyone has fights once and a while. If you’re married and have been for a while, chances are you might feel like killing one another on those stressful days. Only some people actually attempt to act on those wishes.

A woman had to be submitted to the hospital after the police claimed that her husband had shot her inside of their Mesa Home.

The Mesa Police Department said that they responded to a call that came out, just after six o’clock in the evening. The call came from an upscale gated community of “Las Sendas”. Las Sendas is located near the McDowell and Power Roads.

Police are keeping quiet about this scene. They are releasing very little information about what happened. However, they have said that the couple’s two children were inside of the house at the time of the shooting. Those poor kids must have been scared to death! The police say that the couple’s children are a young girl and an adult son. Hopefully the adult son can shed some light on the situation.

The police also say that the woman who was shot, is now in the hospital. Hopefully she will make a full recovery. The husband of the victim has been taken in for questioning. However, he has not been formally charged at this time.

The Mesa Police Department are now on the case and are investigating the incident.
